Booking, cancellation and conduct conditions for private e-bike tours
1. Object of the Service
The service concerns the organization and conduction of private e-bike tours, on itineraries established by the organizer. The tour is reserved exclusively for the participants indicated at the time of booking and is not comparable to a public or collective transport service.
2. Booking and Fee
The booking is considered confirmed only upon payment of the required fee. The fee constitutes the consideration for a tailored service and does not have the nature of a deposit.
3. Cancellation and Refusal of Booking
The organizer reserves the unquestionable right to refuse or cancel the booking up to 30 (thirty) days before the scheduled date of the private bike tour. After this period, the paid fee will be fully retained and non-refundable, for any reason or cause.
4. Weather Conditions and Force Majeure
In the presence of adverse weather conditions or other situations that, at the sole discretion of the organizer, do not allow the bike tour to be conducted safely, the paid fee will still be retained. In such circumstances, the service will not be considered canceled, but: it will be postponed to the first available date, to be agreed upon with the customer, or converted, at the organizer’s discretion, into a voucher equal to the paid fee, valid for 12 months from the date of issue.
5. Exclusion of Refunds
No cash refund, total or partial, nor any form of indemnity or compensation is provided. All incidental expenses incurred by the customer are in any case excluded from refund, including but not limited to: travel, accommodation, e-bike rental, charging, transfers, permits, insurance, as well as costs resulting from non-participation or early termination of the tour. Those who, having registered properly, do not show up at the meeting point at the agreed time have no right to any refund.
6. E-bikes, Technical Failures, and Range
E-bikes used may be owned by the customer or rented through third parties. Any technical failures, battery range problems, component wear, or malfunctions not attributable to intent or gross negligence of the organizer do not give the right to any refund, reduction of the fee, or compensation. The organizer reserves the right to modify the route, shorten the duration, or interrupt the tour for safety reasons.
7. Participant Responsibility
The participant declares to be physically fit, to possess the minimum skills for handling an e-bike with gears, and to strictly follow the guide’s instructions. They must also inform themselves about distance, elevation, and technical difficulty of the route and carefully assess whether they are capable of participating in the activity. The guide still has the authority to evaluate the physical/technical fitness of participants for the activity. The organizer is not responsible for reckless behavior, violations of traffic laws, or damage to persons or property caused by the participant. Minors under 18 must be accompanied by a parent or guardian. The participant must be equipped with the required or provided equipment and ensure it is in good condition: helmet, closed shoes, comfortable clothing, etc. It is very important never to leave the group without first obtaining the explicit consent of the guide. Each participant is individually responsible for any damage caused to property or persons during the activity. Respect for the environment, wildlife, the places, and the people living there is fundamental. The participant may be excluded from the tour if they decide to voluntarily leave the group to follow a different route than the one established by the Guide, releasing the Guide from any liability towards them. By participating in the events, participants implicitly authorize the use of photos taken during the events.
8. Acceptance of the Conditions
By booking and paying the fee, the customer declares to have read, understood, and accepted the general conditions.
